Bill seeking to use copyright-protected works

A law is being debated that aims to regulate the use of copyrighted works in the context of training artificial intelligence models, with the purpose of ensuring respect for the rights of authors and rights holders.

In this way, it seeks to ensure that suppliers, owners, distributors, importers, or any legal entity, natural person, public or private entity that has the administration, control, license, or ownership of Artificial Intelligence (AI) Models and/or Systems, acquire the license to use the protected works or artistic performances in advance and expressly.

An exception to copyright is proposed to allow research organizations and institutions responsible for cultural heritage to conduct text and data mining for scientific research purposes, provided they have legal access to the works.

It proposes a mandatory collective management framework for certain forms of use of protected works, particularly in the musical and audiovisual fields.

Although we believe this bill will be difficult to implement and bring to fruition, it is a step toward establishing a regulatory framework on the matter.
