A bill is currently pending that seeks to regulate the use of works protected by copyright (obras protegidas por derechos de autor) in the context of training Artificial Intelligence models (Inteligencia Artificial IA), with the purpose of ensuring respect for the rights of authors and rights holders.
Accordingly, it intends to require that providers, owners, distributors, importers, or any legal or natural person, public or private, that holds administration, control, license, or ownership of Artificial Intelligence Models and or Systems (Modelos y o Sistemas de Inteligencia Artificial IA), obtain a prior and express license for the use of protected works or artistic performances (obras o prestaciones artísticas protegidas).
The bill proposes a copyright exception (excepción a los derechos de autor) allowing research organizations and institutions responsible for cultural heritage to conduct text and data mining (minería de textos y datos) for scientific research purposes, provided they have lawful access to the works.
It establishes a mandatory collective rights management framework (gestión colectiva obligatoria) for certain forms of use of protected works, particularly in the music and audiovisual sectors.
Although the practical implementation and enforcement of this bill would be complex, it represents an initial step toward defining a regulatory framework in this field.
